In two of my previous post I discussed the Jodi Arias murder trial and how there is going to be a media coverage ban on the penalty phrase retrial well here comes the objection from the news media outlets stating there first amendment rights are being violated ...
"The public is deprived of its First Amendment right to attend criminal proceedings," Bodney said. "The public has a right to be heard before they're just locked out." The First Amendment of the U.S. Constitution guarantees such basic rights as freedom of speech and the press.
The judge decided to ban any media coverage of the next phrase of Ms. Arias trial because of all the national attention her murder trial got and her defense team argued that the attention has had an effect on a potential jurors and may lead to an impartial jury which is a violation of her rights ....who rights are really being violated here?
To be continued
I think it is absolutely crucial to restate the purpose of the 1st Amendment, and thus the Constitution. So often it is cited when people get upset for something someone said in colloquial conversation. However, the entire Constitution is designed to protect our country from the government; more specifically a judge who would try to silence the press. As an employee of a court system (that we pay for through our own taxes by the way), it is illegal, by the LAWS set forth in the Bill of Rights of the Constitution, the highest law in our land, for the 1st amendment to be violated.
